Acceptable Use Policy and Terms and Conditions
Door Peninsula Internet, Inc., a Wisconsin corporation (DoorPI) provides Internet access
to an account holder (Subscriber) in exchange for payment of fees and compliance with the
terms and conditions that follow. By continued use of the services of Door Peninsula
Internet, Inc. (DoorPI), I acknowledge that permission is granted to me the use of Door
Peninsula Internet's services according to the terms of this agreement.
I understand that unauthorized use of Door Peninsula Internet, Inc.'s services includes
but is not limited to the following:
Any criminal or illegal activities.
Infringement of any copyright, trademark, patent or proprietary rights of others.
Sending or posting fraudulent or harassing electronic messages (including
"spamming").
Sending a message's content to an unreasonable number of mail addresses (five or more
addresses who have not requested the e-mail).
Unsolicited mailing of commercial sales pitches.
Using a DoorPI e-mail address to collect responses from unsolicited commercial e-mail.
The use of IRC bots is prohibited.
Use or attempted use or possession in ones account of programs to shut down the system,
defraud other users, or gain unauthorized access to computers, networks, file areas or
system privileges.
Running background processes of programs on your UNIX shell account while not logged in.
Having pornography, obscenity or downloadable virus code on a DoorPI WWW or FTP directory.
Placing files containing commercial software in file areas readable by the public.
Attempting to impersonate any person. The use of anonymous re-mailers and nicknames is not
considered impersonation.
Any activity that adversely affects the ability of other persons or systems to use
DoorPI's services or the Internet.
Customers of DoorPI must be of adult age (18 years old) or have parental consent for
DoorPI services. The minor's guardian agrees to all terms of this agreement and is
responsible for all actions taken by the minor.
I agree to indemnify and hold harmless DoorPI from any claims resulting from my use of the
service which damages myself or another party.
Account Limitations:
Standard DoorPI accounts allow unlimited "attended" use. This means that the
account should be connected only when a user is actively using the Internet. Connections
that are held for extended lengths of time by automated methods or server software are in
violation of this agreement, and will have their connection terminated or account
suspended.
Standard DoorPI accounts are limited to one PPP login per account at any given time. Use
of the account is expressly limited to the individual or business whose name appears on
the account and dependents of the account holder living at the same address.
Standard DoorPI account users are limited to 10MB of disk space for all their disk usage,
including incoming mail files and personal web pages. DoorPI is not responsible for
backing up these files. Personal web page hosting included in this account is limited to
100MB of network traffic per month.
I understand that DoorPI may immediately terminate my DoorPI subscription at any time, and
that DoorPI can choose to deny any future access through it's services. Refunds for
accounts closed due to a violation of the Acceptable Use Policy will be at the discretion
of DoorPI.
Other Terms and Conditions
Warranties
DoorPI makes no warranties of any kind whether expressed or implied, for the service it is
providing. DoorPI also disclaims any warranty of merchantability or fitness for a
particular purpose. DoorPI will not be responsible for any damage you suffer. This
includes loss of data resulting from delays, non-deliveries, or service interruptions
caused by it's own negligence or your errors or omissions.
Privacy
DoorPI's policy is not to monitor Email communications except to solve an Email delivery
problem. We do reserve the right to monitor any communications through DoorPI facilities
to ensure quality of service. Electronic mail passes through multiple mail servers on the
Internet on it's way to it's destination. Therefore privacy can never be guaranteed on
each mail server. Customer agrees that DoorPI is not considered a secure communications
medium for the purposes of the Electronic Communications Privacy Act, and that no
expectation of privacy is afforded. DoorPI will cooperate with the appropriate legal
authorities in investigating claims of illegal activity.
Technical Support
Technical support is available via telephone and email. Free support is provided to assist
customers with the setup and configuration of DoorPI Internet accounts. Phone based
support is to be used for problems involving the process of dialing into the system and
establishing an Internet connection and also for problems concerning the sending and
receiving of Internet E-mail. It is not to be used for questions about writing WWW pages
or for help on using any operating system. DoorPI is not responsible for the performance
of services provided by organizations outside of DoorPI such as the quality of a
customer's phone line, the speed of connections not owned/operated by DoorPI, or the
operation or reliability of any Internet server/computer not owned/operated by DoorPI.
DoorPI allows various resellers, consultants and retail stores to distribute DoorPI's
installation software and instructions. These entities are independent of DoorPI and
DoorPI is not responsible for any errors or omissions or any other damages resulting from
services and products received from these entities.
Account billing policies
Cash, Check or Money Orders
Minimum payment terms: All payments made in the form of cash, check or money
order must be for three months minimum. Please allow at least three business days for mail
sent via US Postal Service to reach us.
Expiration date updates: When payment is received for an account, the
account will be updated or re-opened for the length of term covered by the payment unless
previous arrangements have been made. Personal accounts will receive an invoice
approximately 15 days prior to the account expiration. Please write your account username
on your check and mail it to DoorPI. If payment is not received for any DoorPI services,
those services will be deactivated until payment is received. There will be no grace
period without the authorization of DoorPI. If a check is returned for insufficient funds,
E-mail will be sent to the account in question indicating that the account holder will be
given five days to clear the problem with DoorPI. There will be a $20. Service charge in
addition to the amount specified on the returned check, which will be payable if the
account holder requests the account to be re-opened.
Credit Card payments
For customers billed monthly by credit card, the account will be open until the customer
closes the account or the card is refused for insufficient funds or is expired. Monthly
credit card customers will not receive an invoice so their card statement will act as a
receipt. Customers may also pay by credit card for three, six or twelve months but will
not be automatically renewed. These terms will be invoiced and renewed at the customer's
option as with the cash accounts described above. When a customer's credit card expiration
date changes, it is the responsibility of the customer to notify DoorPI. If DoorPI
receives notice that a card has been declined a charge from DoorPI, an E-mail will be sent
stating that the charge was declined and that the users account will be closed if DoorPI
does not receive a response. The customer has 10 days to respond. The preferred means for
response is billing@doorpi.net. If no response is received the account will be closed on
the 12th day. If the card comes back as "PICKUP CARD", indicating a lost,
stolen, or extremely delinquent card, the user account will be closed immediately.
Prepaid Internet access accounts are considered contracted service and are non-refundable,
non-prorated.
Cancellation
All Internet access cancellations must be requested in writing by US Mail or by Email to
billing@doorpi.net and received prior to beginning of the subscriber's next service period
or the subscriber is liable for the next months service regardless of usage. DoorPI is not
responsible for cancellations by phone.
Changes in Policy, Terms and Conditions.
DoorPI reserves the right to change any of these policies, terms and conditions upon
notice published online via the www.doorpi.net web site. Subscriber's use of DoorPI after
such notice shall constitute acceptance of the modifications.
General Internet Etiquette
1. The Internet is a cooperative effort; it is fairly easy for a single user
to cause severe problems for the entire Internet, and thereby cost everyone on the
Internet a great deal of lost time and money. Therefore, any user who violates these
policies runs the risk of having their account deactivated immediately.
2. "Personal" accounts are for personal use only! Please do NOT share
them with your friends or sublet time or do business via your account unless you have a
business account.
3. Web pages are available as part of every Door Peninsula Internet account, and we make
no restrictions on content as long as it's legal and it doesn't adversely affect the
operation of Door Peninsula Internet. Again, if you wish to conduct business on your web
page, you need a business account.
4. Please be careful with e-mail. Electronic communications in general tend to lack many
of the social cues that we use in face-to-face or vocal communications, so it's easy for
tempers to flare or for people to take what you've said in a bad light. If you get some
mail that you really don't like, your best bet is often to simply delete it, and assume
that the other person is being an idiot. It is considered rude to type in all upper
case letters as it is like yelling.
5. Usenet (news) is a complex place and there are many rules to watch out for in order to
prevent misunderstandings. First, read the FAQ. Most
newsgroups have a FAQ (Frequently Asked Questions) file that is posted monthly; that file
will typically answer the most often asked questions on that newsgroup, and will save you
from feeling silly for posting a "newbie" type question. Second, stay on the
topic. The FAQ for a given group will give details on what kind of messages are considered
on-topic. If you have not already done so, you are strongly encouraged to read the
introductory postings in news.announce.newusers before posting any messages in any
newsgroup.
